The Short Version

Laramie County says the generating facility is an essential service utility, meaning the use itself is permitted without the normal County governing-body approval. That does not mean the project is exempt from every permit or review.

Why It Matters

This is not a normal zoning fight with one public hearing and one yes-or-no vote. Residents may need to follow several agencies at the same time to understand where decisions can still be influenced.

What We Know So Far

  • County Planning told Black Hills Energy that essential service utilities are permissible in unincorporated Laramie County.

  • The County letter says a commercial site plan is still required.

  • Applicable access, building, floodplain and other County permits must still be obtained.

  • The same letter says the County understood Black Hills intended to apply through the Wyoming Industrial Siting Division.

  • Wyoming DEQ separately handles air construction permitting for new sources that may emit air contaminants.

  • The Wyoming PSC can review large power facilities and some transmission infrastructure.

What We Still Need to Know

  • Will the project meet the legal threshold for Industrial Siting review?

  • Will a PSC certificate be required?

  • Which County permits will be required?

  • What air permit will apply?

  • What water rights or well permits will be needed?

  • Who will approve the gas pipeline?

  • Who will approve the transmission route and substation?

  • How can residents become formal participants in each process?
